The First-tier Tribunal (England) and The Mental Health Review Tribunal (Wales) are independent bodies whose function is to review detention under the Mental Health Act 1983.

The Tribunal consists of a Panel of three whom can direct discharge from hospital. They can also make recommendations regarding Section 17 leave, transfer to another hospital, or whether the Responsible Clinician should consider a Community Treatment Order. We can help those who wish to apply to the Tribunal, or have been referred for a Hearing, and we will advise throughout each step of the process.

Tribunal hearings usually take place at the hospital and we will be there to represent you on the day of your hearing.

Our advice, assistance and representation is free of charge in these circumstances under our Legal Aid Agency contract.
