False Accusations of Theft
An employee at a national supermarket was accused of stealing a customer’s iPhone that had been left on the checkout counter while the employee was serving the customer. The employee denied the accusation, but he was still charged and given a court date. He came to us for help after being charged. During the prosecution, we made a defence application for third-party disclosure, requesting that the network provider release specific data related to the iPhone. The data was not provided but the prosecution did drop the charges against the employee.
False Allegations of Sexual Offence
A retired police inspector was the subject of allegations. At the police station, a “no comment” interview was conducted. A written statement setting out his defence to the allegations was handed in to the prosecution upon charge. Other defence work was also undertaken. At trial, he was represented by Queen’s Counsel. The jury found him “not guilty” on all charges.
False Allegation of Malicious Communication.
The police arrested our client and swiftly took them to a police station. They were charged with making a Malicious Communication and received a summons to appear in court. Our solicitor worked hard to show that the allegations were false, with no evidence or basis to them. Due to our solicitor’s hard work, the court accepted that the allegations made against our client were false, and the case was dropped.
Our client decided to report the false allegation to the police. The police did not investigate the matter properly. We were instructed to bring a private prosecution against the individual concerned. This private prosecution progressed to a Crown Court trial.
